TERMS & CONDITIONS
PAYMENTS:
Initial:
A non-refundable 50% retainer is due at the time of booking. The remaining balance is not due until approval of the cover is accepted. Final files won't be sent until payment is complete.
If you do not pay your deposit, you will not be locked into your date and we retain the right to fill that slot.
Final Payment:
Final payments are due within 72hrs of the final cover file approval. If you miss the deadline, there is a $50 fee. If you let Opulent Designs know beforehand that you'll be late, there will be no fee.
Rush Orders:
Although Opulent Designs offers rush orders, they decide whether they can take a rush order. Rush covers/branding/etc. have an added fee of $50 for a week rush and $100 for a day rush.
Pre-mades:
Pre-made sales are final. There aren't any refunds or exchanges done after the invoice is paid. Once the invoice is sent, you have 24hrs to pay. Failure to do so will put it back on the market. There's also a form to fill out. Once that's filled out with your information, it takes 1 - 2 weeks to complete all final files.
Proofs:
Opulent Designs will send one proof unless otherwise discussed before starting.
Alterations:
Opulent Designs offers three major alterations during design. This would be image changing, theme changes, and bigger elements. Font, coloring, and title changes during the process aren't considered a revision.
Changes to images:
If the main theme changes after work has begun, there will be an additional $50 charge per image change, regardless of who provides the image.
Work Flow:
Please try to book your cover as soon as possible and well ahead of any scheduled deadlines. Each additional change will take extra time on Opulent Designs' part to complete. Opulent Designs isn't responsible for missed deadlines on the Client’s end due to changes and late bookings.
Once placed on the schedule, Opulent Designs emails you with a cover design form at the beginning of the month or your designated week with the form. Please email any Pinterest/Mood boards you may have. It gives both you and the designer a stronger connection to your vision.
Opulent Designs goes in booked order. First come, first served.
Changes after approval:
The Client understands that no one except Opulent Designs should alter the cover. The Client also understands that additional charges may apply for any alterations after approval and/or after final files are sent. Changes after the final files are sent will begin at $50 and may increase with the number of files/changes that need to be altered. This option will only be available for six months after the original final files have been sent.
DESIGN SERVICES:
Prices are subject to change at any time and without warning. Price is only guaranteed upon receipt of the retainer.
IMAGE EXPENSES:
Stock Images
If the Client chooses to provide the cover image: They maintain the rights to it. Just the image they provide. Details, such as flourishes, small extra images, and certain back images, are included in the cover design package and will not be the Client’s responsibility. The Client must obtain the correct rights and permissions for the use of the photo they are providing. Client agrees to indemnify and hold harmless Opulent Designs from any copyright and permission infringement action resulting from materials client provides.
AI USAGE:
Opulent Designs doesn't use AI imagery. While mistakes do happen, and trusted sites haven't been labeling AI correctly, we are doing our due diligence to avoid it. If we happen to mistake an image that has been artificially made and use it within our design, we will make it right and alter the cover to remove it. Accidents are bound to happen, and we're only human, but we will make it right if it happens.
OD's Photo:
The image chosen will only be used for this project. OD maintains full rights to this photo. Other authors/designers may have the same or similar images/models, and OD can't be held liable for other covers that contain the same imagery.
Photo may NOT be sold, reused, or used out of context aside from the specified book-related printing, reproductions, and otherwise. It may be used for paperback and ebook promotion and online promotional use. It may not be used for resale items other than the eBook, and print book. If other sale items will be created from this photo, the Client will need to purchase the extended rights to the image.
Photo may not be used on any other printed work by alternate designers unless otherwise discussed. OD maintains the rights to the specified photo.
Under any circumstances, Each image shall not be altered without OD's prior permission.
CANCELLATION:
In the event of a cancellation, before work starts, no further expenses will be owed. The remaining balance will be owed if the work has begun on the project. Once work is booked, no refund will be given.
OWNERSHIP:
OD maintains the full rights to all designs. Designs and their concept, including layout, image style, coloring, placement, and fonts, aren't permitted to be recreated or altered by another person.
The Client understands that no one except OD should alter any image. The client also understands that additional charges apply for any alterations after approval and/or after sending final files.
OD controls the rights to the cover to use as any self-promotion, portfolio, client viewing, etc.
PSD Files for Audio or Otherwise:
Opulent Designs offers PSD files for audio and otherwise in the case of publishers seeking. You can purchase an audio cover add-on for the cover or a flat JPEG file of the audio cover. PSD files are OD's work layer-by-layer, and they don't allow images they've created to be manipulated in any form. You can, however, ask for permission to recreate the series/images you want to use if you no longer want to use OD as a designer.
ATTRIBUTION
Opulent Designs requires cover design credit to appear in the Client’s book, whether on the cover or inside on the copyright page.

LIABILITY
OD isn't liable for damages of any kind, including loss of revenue, profits, business, reputation, or data, in any way related to our graphic design services. OD isn't responsible for any claim, loss, or injury based on errors or inaccuracies on our site or our clients’ written documents once the cover has been approved.
Should OD take longer to complete the project than originally indicated, i.e., due to a family emergency or act of nature, the Client will be contacted via email to agree upon a new project completion date. If a client seeks a different solution, we will discuss that.
CODE OF FAIR PRACTICE
OD acknowledges that to the best of their knowledge, the work prepared is an original creation and has not been previously published, and/or consent to use has been obtained. The work prepared contains no scandalous, libelous, or unlawful matter. The Client and/or others may not use OD products in any way that may infringe upon the rights of others.
ACCEPTION OF TERMS
Both OD and the Client will acknowledge acceptance of these terms. By acknowledging this contract, the Client agrees to hold OD entirely free from any liability, including financial.
